Artificial Intelligence is rapidly transforming healthcare—from diagnostics and imaging to clinical trial optimization and personalized medicine. However, this evolution comes with a major shift: increasing regulatory scrutiny across the European Union.

Under the EU AI Act (entered into force in 2024), most healthcare AI applications—including diagnostic software, clinical decision support systems, and AI-enabled medical devices—are classified as **high-risk technologies**.

### **What’s Changing in Practice?**

The regulation introduces a clear and robust set of mandatory requirements:

• **Rigorous risk management** – high-risk AI systems must implement continuous risk assessment and mitigation processes

• **Data quality and governance** – use of high-quality datasets to minimize bias and errors

• **Extensive documentation** – detailed technical documentation for conformity assessment

• **Traceability (logging)** – automatic recording of system activity for audit and control

• **Human oversight** – mandatory mechanisms to prevent fully autonomous, uncontrolled decisions

### **Key Timelines (Official Milestones)**

• **August 2026** – most obligations for high-risk AI systems become applicable

• **August 2027** – full compliance deadline for AI integrated into regulated products, including medical devices

There are also ongoing discussions at EU level about **potential extensions to 2027–2028** for certain categories, reflecting the complexity of implementation.

### **Why Is Medical AI Considered High-Risk?**

Because these systems directly impact **patient safety and clinical decision-making**. Under the AI Act, any AI that functions as part of a medical device or supports clinical decisions is automatically classified as high-risk.

### **What Does This Mean for the Industry?**

The impact is tangible and measurable:

➡️ **Higher development and validation costs**

– additional compliance, documentation, and audit requirements increase investment levels

➡️ **Longer time-to-market**

– more complex regulatory and certification processes

➡️ **Improved quality and trust**

– more robust, transparent, and clinically reliable AI systems

This marks a fundamental shift: in the EU, AI must prove its safety **before deployment**, not after.

### **The Role of CROs in a Regulated AI Ecosystem**

As requirements grow more complex, CROs become critical strategic partners.

Organizations like Tigermed EMEA can support sponsors with:

• clinical validation strategies for AI solutions

• alignment with regulatory frameworks (AI Act + MDR/IVDR)

• data governance and traceability

• preparation of compliance documentation

### **Looking Ahead**

Stricter regulations are not a barrier—they are a **necessary foundation for sustainable innovation in healthcare**.

 -Yes, costs will increase.

 -But so will quality.

And in healthcare, **trust is the ultimate currency**.
